AI Risk Exceptions

Who may accept a known control gap, for how long, and under what restrictions?

Definition

An AI risk exception is a documented decision to operate under specified conditions despite a known departure from an internal control requirement. It identifies remaining risk, the accountable decision-maker, compensating measures and conditions for expiry or withdrawal.

A risk exception should make a difficult decision visible. It describes what the organization is choosing to tolerate, why alternatives were rejected and who will respond if an assumption proves wrong. A deadline or senior sponsor does not explain the actual exposure.

What it covers

Gap
Identify the unmet control and affected workflow.
Decision
Name the role authorized to accept the exposure.
Conditions
Specify restrictions and stop triggers.
Closure
Assign remediation, review and expiry behavior.

Accepting risk is different from asserting that a control exists. Record missing features as missing. A manual workaround may reduce exposure, but its capacity and reliability need assessment. The decision must also respect requirements the approving role has no authority to waive.

In practice

Practical design patterns by Min.

  • Describe the consequence of the gap before the business deadline.
  • Consider a reduced-scope alternative.
  • Record evidence and uncertainty supporting the decision.
  • Require fresh review before renewing an exception.

Use a compact record: workflow version, unmet requirement, scenario, affected parties, restrictions, evidence, accepting owner, remediation owner and expiry. Link it to inventory and release decisions. Define what happens at expiry so continuation does not depend on someone remembering an email.

Acceptance is one possible risk response

NIST AI RMF Manage 1.3 includes acceptance among response options; Manage 1.4 addresses documenting residual risks. This does not mean every risk is acceptable or that an internal waiver determines compliance.

Identify the control at issue

NIST SP 800-53 organizes security and privacy controls. A relevant control reference can clarify a gap, while applicability and exception authority remain separate decisions.

Working example

A pilot lacks its planned audit export

A team requests a limited trial before the standard evidence export is available.

  1. Assess missing evidence and applicable requirements.
  2. If authorized, constrain the trial and establish a reviewed alternative evidence path.
  3. End or reassess the trial at expiry or upon a material failure.
Illustrative scenario, not a reported deployment.

Why the controls matter

The proposed pilot may be unacceptable if the alternative evidence cannot support necessary oversight. Reduced permissions or synthetic data could change that assessment. Document those conditions rather than suggest that every missing control can be compensated for by a signed document.

Common pitfalls

  • Using a waiver to claim compliance with an unmet requirement.
  • Approving vague AI risk rather than a specific gap.
  • Allowing a temporary exception to become permanent without review.

Repeated renewal is a signal to reconsider the deployment, resource allocation or requirement. Do not hide uncertainty behind a precise score. Identify what is unknown and what evidence would change the decision to continue, restrict or stop. Keep the original risk visible when remediation dates move.

Questions for operational review

Use these questions to decide what evidence your team needs. They are editorial prompts, not a compliance checklist.

  • Does the approver have authority over this requirement?
  • What invalidates the exception before expiry?
  • What happens if remediation remains incomplete?
